In short

  • It's free and intended for professionals with a NIF.
  • We are a listings space: the deal is made between buyers and sellers.
  • Only list legal products, with true information and no contact details in the text.
  • We may remove listings and suspend accounts that don't comply with the rules, and we tell you why.
  • Reference prices are for information only and don't guarantee the price of any deal.
  • Portuguese law applies.

This summary is a reading aid, but the full text is what counts.

The email above is also our single point of contact for users and authorities, including for the purposes of Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). You can write to us in Portuguese or English.

2.Purpose and acceptance

These terms govern access to and use of the agroeurope site and the services we provide on it. To create an account you must accept them. If you only browse the site, without an account, the rules relating to browsing apply.

How we process personal data is explained in the privacy policy.

3.What the platform is

agroeurope is an online space where businesses with a NIF publish offers (to sell) and requests (to buy) for farm, livestock and forestry products, and contact each other through messages.

We store and display the information users publish, at their request. We are therefore an intermediary provider of network services, in the form of hosting (Article 16 of Decree-Law no. 7/2004, of 7 January), and a hosting service provider within the meaning of the Digital Services Act.

We are not a party to deals between users. We don't buy, we don't sell, we don't represent either party, we don't receive payments and we don't handle transport, storage or delivery.

The platform is intended for professional use. By registering, you declare that you act in the course of your farming, commercial, industrial or professional activity, and not as a consumer.

The operator and the entities in its group may use the platform like any other user, with their own account, under the same conditions and subject to these rules. They have no privileged access to other users' non-public data (NIF, contact details, messages and declared final prices) and do not use them in their commercial activity: the administration only consults them to manage the platform.

4.Registration and account

Seeing listings and prices doesn't require an account. To post listings and contact other businesses, you need an account.

  • You must be at least 18 years old and have the authority to act on behalf of the business you register.
  • The details you give must be true, complete and up to date: business name, NIF, municipality, contact person, phone and email. You can correct them in your account at any time.
  • Each NIF can only have one account. You may not use a NIF that does not belong to the business you represent, or create accounts on behalf of others without authorisation.
  • You need to confirm your email before posting or contacting.
  • The password is personal. Choose one you don't use on other sites, don't share it and let us know at once if you suspect misuse. You are responsible for activity carried out with your account, unless it results from a failure on our part.

The badge Verified is awarded manually by us, after we confirm the business's details, and may be withdrawn if those details can no longer be confirmed. It is not a guarantee about the business, its products or the fulfilment of deals.

5.Listing rules

When you post a listing, you undertake that:

  • it is about a farm, livestock or forestry product in the catalogue, located in Portugal, whose production, possession and sale are legal;
  • you list in your own name: in an offer, you have the product or are entitled to sell it; in a request, the intention to buy is real and for your business. Wholesalers, cooperatives and traders may list products they have bought or that have been entrusted to them for sale;
  • the information is true and not misleading, including the product, quantity, price, quality, location, availability date and photos;
  • you only state “organic” or “integrated production” if the production is certified or recognised under the law;
  • you only use protected designations (PDO, PGI and similar) if you are entitled to them;
  • the text contains no emails, phone numbers, website addresses or other forms of contact: contact details are shared in messages, to protect you from spam;
  • the photos are of the product listed and you have the right to use them;
  • you don't repeat listings for the same lot and you keep the listing up to date: when it's no longer available, mark it as sold or withdraw it.

Listings stay active for 60 days and can be renewed. The price is given per reference unit of the product; “to be agreed” means no price was given.

A listing is an invitation to negotiate. The contract only exists when the parties reach an agreement between themselves.

6.Prohibited content

You may not publish, send or share on the platform:

  • products whose sale is prohibited or requires authorisations, registrations or documents you don't have, such as animals without the required identification or health documents, or timber and cork obtained in breach of forestry rules;
  • false or misleading information, including fictitious prices or quantities that distort the market statistics;
  • illegal, offensive, defamatory, discriminatory or violent content, or content that incites hatred;
  • other people's personal data without a legal basis;
  • advertising for other services, chain messages, spam or mass messages;
  • attempts at fraud or at obtaining passwords, payment details or other data for unlawful purposes;
  • content that infringes copyright, trademarks or other third-party rights;
  • malware, automated data collection (other than by search engines that respect the robots.txt file) or any action that harms the operation or security of the platform.

7.Moderation, reports and suspension

We have no general obligation to monitor content (Article 12 of Decree-Law no. 7/2004 and Article 8 of the Digital Services Act), but we act when we become aware of illegal content or content contrary to these terms.

Reports

Anyone, with or without an account, can report a listing with the “Report” button on the listing page, or write to us at contacto@comercionacional.pt. So that we can look into it, give the address of the content, the reason why you consider it illegal or against the rules and, if you want to know the decision, your name and email. By reporting, you declare that you do so in good faith and that the information is, to the best of your knowledge, accurate. We review reports diligently and objectively.

Measures

If content or an account doesn't comply with the law or these terms, we may remove the listing, withdraw the Verified badge, suspend or block the account (temporarily or permanently) and, where the law requires, report the facts to the authorities. Measures are proportionate to the seriousness of the breach and whether it is repeated.

How we decide

At the time of publication, the site automatically rejects text that appears to contain emails or phone numbers. Decisions to remove listings and to suspend or block accounts are taken by a person on our team.

Explanation and review

When we remove a listing or block an account, we tell you why, by email or on the platform itself, unless the law prevents it. If you disagree, reply to that email or write to us: we review the decision and, if there was a mistake, we restore the content. Reports that are manifestly unfounded or repeated may no longer be reviewed.

8.Communications between users

  • Messages are for dealing with listings. Use them politely and don't send mass messages or advertising.
  • The contact person, phone and email are only shown to the other side when you choose “Share my contact details” in a conversation. Whoever receives them may only use them to handle that deal.
  • We email you when you receive a message, and other emails needed for the service: account confirmation, password recovery, listing expiry and administration decisions. You only receive alert summaries if you ask for them. The “This week's prices” newsletter comes with the account: cancel whenever you want, with the link in each mailing.
  • We don't read messages routinely. We only look at them when necessary to review a report, protect the platform's security or comply with a legal obligation.

9.Reviews, alerts and newsletter

  • After a deal (the listing marked as sold or bought, or the conversation marked “deal closed”), each party to a conversation in which both exchanged messages can review the other, once per deal: from 1 to 5 stars and a short comment.
  • Reviews are public on the reviewed business's profile, with the name of the reviewer. Write only about the deal, truthfully and politely: no contact details, insults, personal data or unfounded accusations. A comment with contact details is rejected.
  • Any account can report a review. The administration may hide reviews that break these rules; once hidden, a review no longer appears or counts towards the average. We are not responsible for what each user writes in reviews.
  • Alerts (“Let me know”) and the “This week's prices” newsletter are optional and free. You turn off alerts and cancel the newsletter whenever you want, with the link in each email, without signing in.

10.The deal is between the parties

Purchase and sale contracts are concluded directly between users, outside the platform, on the terms they agree. We are not a party to those contracts and don't guarantee them.

It is up to the parties to confirm each other's identity and reliability, check the quality, quantity and conformity of the products, and comply with the legal obligations of the deal, in particular tax (invoicing), transport, sanitary, phytosanitary, labelling and traceability obligations.

We are not liable for non-performance, product defects, delays, non-payment or other disputes between users, which are settled between them. If you suspect fraud or another crime, let us know and report it to the competent authorities.

11.Reference prices

For each product we show statistics calculated from active listings (available quantity and average asking and offered prices, weighted by quantity) and from the sales users declare when marking a listing as sold. Prices very far from the product's reference are left out of the averages, and we only show the sale price of a product when there are sales from at least 3 businesses in the last 30 days, so that no specific deal is exposed.

We also show, when they exist for the product, the reference prices published by the European Commission on its agri-food data portal, converted to the unit used on the platform. Source: European Commission; reuse of these data follows the Commission's reuse policy (Decision 2011/833/EU).

These figures are for information only. Listing prices are asking or offered prices, not transaction prices, and official data may arrive late, be revised or not exist for all products. We don't guarantee that they are accurate, complete or up to date, and they are not commercial, financial or investment advice. The price of each deal is whatever the parties agree.

12.Intellectual property

The site, the agroeurope brand, the design, the code and the organisation of the content belong to the operator or to whoever licensed it, and you may not copy or reuse them without authorisation, except where permitted by law. The icons are from the Lucide library (ISC licence) and the font is Inter (SIL Open Font License).

What you publish (texts, photos and listing data) remains yours. By publishing, you give us a free, non-exclusive licence, valid while the content is published, to store it, reproduce it, adapt it to the site's format (for example, shrinking photos) and display it publicly on the platform, in shares and in search engine results, solely to run and promote the platform.

You guarantee that you have the necessary rights over what you publish and that it doesn't infringe third-party rights.

Aggregated, anonymous data resulting from listings, such as average prices and quantities per product and per day, may continue to be used in statistics after the listing or account is deleted.

13.Liability

We do our best to make the platform work well and securely, but we don't guarantee that it will always be available, uninterrupted or error-free. We may suspend access for maintenance, updates or security reasons.

We are not responsible for content published by users, except in the cases provided for by law for hosting providers, in particular if, after becoming aware that content is manifestly unlawful, we do not remove it or disable access to it promptly.

We are not liable for indirect damage, loss of profits or loss of business resulting from use of the platform, or for deals between users. These limitations do not apply in cases of wilful misconduct or gross negligence, to damage to life, physical integrity or health, or in other cases where the law does not allow liability to be limited.

You are responsible for the content you publish and for any damage you cause to third parties or the operator by not complying with the law or these terms.

14.Free use and future services

At the moment, using the platform is free: we don't charge for registration, listings or messages, and we don't charge commission on deals.

We may offer paid services in the future. If that happens, we will give at least 30 days' notice, state the price and conditions before any payment, and nothing will be charged without your express choice.

Third-party advertising. The site is paid for by advertising from companies in the sector (fertilisers, machinery, transport, insurance, credit, analysis, consultancy and other services), which always appears marked “Sponsored” or “Supported by”. The profiles in the “Services for producers” directory are also advertising, by the companies themselves, and appear marked “Company profile”. The advertiser pays for the advertising, not those who use the platform. Advertising is not a recommendation from us: confirm the conditions directly with the advertiser, who is responsible for what they advertise. We don't accept misleading advertising or advertising for illegal products or services, and we may withdraw it at any time. Advertisers have no access to your data: they only receive the number of views and clicks per day.

15.End of use

You can stop using the platform and delete the account whenever you want, in your account. Deleting the account deletes the business, the listings and the photos, as explained in the privacy policy.

We may block or close your account under section 7. We may also close the platform; in that case, we will give at least 30 days' notice, unless a serious reason prevents it.

16.Changes to the terms

We may change these terms, for example to keep up with changes in the law or the service. The date of the last update is at the top of this page.

If the change is significant, we'll let you know by email or on the platform at least 15 days before it takes effect. If you don't agree, you can delete the account before that date; if you continue to use the platform after it, the new version applies.

17.Applicable law and jurisdiction

These terms are governed by Portuguese law.

Before going to court, we try to settle any issue amicably: write to us. Disputes between the operator and users fall under the jurisdiction of the court of the district where the operator has its registered office, without prejudice to mandatory legal rules.

18.Contacts and complaints

For any question about these terms, write to contacto@comercionacional.pt or use the contact page.

You can also lodge a complaint in the Electronic Complaints Book (opens in a new window).
